What’s the difference between a living will and a last will?

Living will vs. last will

A living will (also known as a health care directive) is a legal document communicating a person’s desires and preferences about medical treatment. A living will comes into play when you’re unable to communicate these decisions yourself. With a living will, your loved ones can have more peace of mind knowing you have been able to thoroughly express your wishes.

On the other hand, a last will — often called a “last will and testament” is a legal document that specifies a person’s wishes concerning asset distribution after death. Without a will, a person would die “intestate”, and their assets would pass to others according to state law. A will can help to ensure beneficiaries receive assets according to your wishes.

The key distinction lies in timing, a living will takes effect when you’re still alive but incapacitated, while a last will only becomes relevant after your death.
