How to avoid work interruption due to EAD renewal delay

If you’re a Tampa resident with an Employment Authorization Document (EAD), renewing it on time is crucial to avoid work interruptions. Knowing when and how to apply for your EAD renewal can help you maintain your right to work and financial stability.

An EAD, a work permit, allows non-U.S. citizens to work legally in the country. It’s vital for many immigrants, including asylum seekers, students on certain visas and those adjusting their status.

How to apply

To renew your EAD, you must:

  • Fill out your Form I-765: The latest version of the Application for Employment Authorization form is available on the USCIS website.
  • Gather necessary documents: Prepare your Form I-765, a copy of your current EAD, two passport-style photos and, if applicable, a fee waiver request.
  • Pay the filing fee: The fee is $410. Eligible applicants can request for fee waivers.
  • Submit your application: Apply online or mail your form to the appropriate USCIS office. Keep records of all your documents.
  • Track your application: Use the USCIS online case status tool or sign up for case updates via email or text.

Automatic EAD renewal extension

The USCIS provides eligible renewal applicants whose EAD has expired with an additional period of employment authorization and EAD validity. This automatic extension allows the agency to address pending EAD caseloads with reduced capacity.

Effective April 2024, USCIS’s new temporary rule increased the automatic extension period for EADs and authorization from 180 to 540 days for certain eligible applicants. It will remain in effect until September 2025.

The rule provides critical support for families who rely on an applicant’s employment and encourages workforce diversity. However, it is still advisable to consider early application to buffer unexpected delays, reducing potential stress and uncertainty.

Consulting an immigration law attorney can help inform you about any policy change affecting your renewal. They can also provide you support when defending against discrimination based on immigration status.
