Limited Guardianship Services
Preserving Autonomy with the Least Restrictive Alternative
Under Florida law, the guiding principle of guardianship is to utilize the least restrictive alternative that will adequately protect the individual. When an adult has some physical or cognitive impairments but retains the ability to handle certain personal or financial affairs, a Florida court will establish a Limited Guardianship rather than taking away all legal rights.
What Is a Limited Guardianship?
Under Florida Statute Β§ 744.102(9), a limited guardianship is one in which the court finds that the person is incapacitated to do some, but not all, of the tasks necessary to care for their person or property. The court will only delegate specific, enumerated rights to the guardian, while the ward retains every other constitutional right.
Rights That May Be Delegated vs. Retained
Florida courts distinguish between delegable and non-delegable rights:
- Delegable Rights (May be transferred to guardian): The right to contract, sue and defend lawsuits, apply for government benefits, manage property and bank accounts, consent to medical and mental health treatment, and decide residential placement.
- Retained Rights (Often preserved for the ward): The right to vote, marry, hold a driver's license, travel, seek employment, and make personal lifestyle decisions to the extent feasible.
Why Limited Guardianship Is Preferred
Limited guardianships promote dignity and self-esteem by allowing vulnerable adults to maintain meaningful control over their everyday lives while providing a critical safety net where assistance is truly needed. It is frequently applied for young adults with mild developmental disabilities turning 18 or seniors in early stages of memory impairment.
